Sexual Violence Policy
- York Construction Academy (YCA) has implemented this Sexual Violence Policy, which defines sexual violence and outlines the procedures for training, reporting, investigating, and addressing complaints of sexual violence involving its students, whether on campus or at its events.
- YCA is dedicated to providing its students with an educational environment that is free from sexual violence and treats students who report incidents of sexual violence or harassment with respect and dignity.
- The person accused of sexual violence will be called the “Respondent” while the person making the allegation will be referred to as the “Complainant”.
- Definition of Sexual Violence encompasses any physical or psychological act that is performed, threatened, or attempted against a person without that person’s consent, regardless of whether it is sexual in nature or targets that person’s sexuality, gender identity, or gender expression, is considered sexual violence. It can take many different forms, including voyeurism, indecent exposure, harassment, sexual assault, and exploitation.
Education, Reporting and Responding to Sexual Assault
- Every contract that YCA has with its students will contain a reference to its sexual violence policy. A copy of the policy will also be given to YCA staff, along with training on how to report, look into, and handle student reports of sexual assault. Any business that offers internships to students must also abide by the applicable laws and inform the students of its policy regarding sexual violence.
- Reports of occurrences or complaints of sexual violence should be made to YCA’s School Director, Vlad Protsenko.
- Unless there is an immediate danger or there is reason to believe that someone else could be in danger, YCA will make every effort to keep personal information pertaining to the inquiry private. The records shall be stored apart from the files of the Respondent or Complainant.
- Students are free to report occurrences of sexual violence or decline to assist with the investigation of such incidents.
- However, if the safety of the community or campus is in jeopardy, YCA may occasionally be compelled by law or its own regulations to launch an investigation or notify the authorities without the complainant’s approval.
- Students impacted by sexual assault will have their needs met by YCA, which will also give them access to counselling, healthcare, and information on other resources.
Investigating Sexual Violence Reports
- Any YCA student may submit a written report or complaint to the staff regarding sexual violence.
- When a report or complaint is received, staff members will get back to you right away to assess whether an inquiry is necessary and whether the complainant wants to be involved. Depending on the parties involved and how severe the charge is, the right investigator will be appointed.
- Relevant procedures during the investigation will include speaking with the Complainant, giving the Respondent information, obtaining details from witnesses, and updating both the Complainant and the Respondent on the investigation’s developments.
- The staff will examine the evidence following the investigation to ascertain whether sexual violence took place. If required, disciplinary action will be taken.
Disciplinary Measures
If it is determined that the Respondent engaged in sexual violence, YCA will take immediate disciplinary or corrective action, which may include termination or expulsion, imposing restrictions, or other appropriate actions.
Appeals
The Complainant or Respondent can appeal the decision resulting from the investigation by submitting a letter to the staff within 10 days.
Making False Statements
Knowingly making a false complaint of sexual violence or providing false information is a violation of this policy and may lead to disciplinary or corrective action.
Reprisal
This policy is violated by taking retaliatory action against a complainant, disclosing information, or participating in the complaint process; disciplinary or corrective action may follow.
Review
While creating, reviewing, and revising its Sexual Violence Policy, YCA will take into account feedback from students. After it is first put into effect, the policy will be reviewed every three years and changed as needed.
Collection of Student Data
Upon request, YCA will provide data and information required by the Ontario Career Colleges under the Ontario Career Colleges Act, 2005.
